My question involves collection proceedings in the State of: California
My 25 year old brother lost his job and is struggling with his debt. Working part time, sometimes, but nothing solid as of yet. He chose to stop paying his Best Buy credit card debt in order to feed his two children. Total owed is about $2k, last payment was made in third quarter of 2013. about 25 days ago he was personally served at his apartment by a process server. He was served a Summons (form SUM-100) stating that he was being sued. I was amazed when he told me this as he has no assets, no real property, no money in the bank, and his car is only worth about $900. The Best Buy credit card charges were smaller items, not something that would be worth anything two years later. I was surprised that it would be worth the cost to attempt collection through the courts. The collection company is in San Jose, he live in L.A.
My question is: how does he respond. He attempted to make use of the free services listed on the summons but was unable to get a reply. I there a specific form that he needs to fill out and file? The suit is in the Superior Court of California, County of Los Angeles in Chatsworth. Should he file bankruptcy if he can't pay? Any advice would be helpful, thanks!
