What is the Likelihood of Prosecution for Unemployment Fraud

My question involves labor and employment law for the state of Wyoming.

I’ve read many of the threads here and it seems that states, generally speaking, are a lot more interested in getting their money back than prosecuting people when it comes to unemployment fraud, however I haven’t really seen much in regard to my state. From an online search, most of the what I’ve seen show that those thatve been prosecuted are those who refused to pay back the money owed for several years, they had $3k+ in debt to repay, or they’d amassed debts in the tens of thousands of dollars. Even then, the vast majority of them (98%) got deferred adjudication under the states first offender rule if they paid the restitution.

Personally, I didn’t report that I’d started working for one of the weeks I’d claimed and was paid a little over $400. I got an audit in the mail a week or so later and promptly called to square things away but was told it’d have to move through the fraud department then I’d get a bill and be disqualified fo benefits for a year. The law allows for prosecution for unemployment fraud and this really makes me uneasy. I’ve even offered to pay the money back I full plus penalties.

Granted, no one can say for sure if I’d be prosecuted or not but what’re the chances of being prosecuted in this instance?
