My question involves landlord-tenant law in the State of: Georgia
My college age daughter and 2 other girls signed a year lease near their college in July of this year. Shortly after moving in things went bad. Found out one of the roommates wasn't actually a student and basically partied all the time - by partied I mean bringing strangers back to the apartment and doing cocaine out in the open. After several physical and verbal attacks by that roommate on the other 2 girls and after having to purchase security cameras for their rooms as the one roommate kept breaking in their rooms and after feeling so unsafe that they locked themselves in their rooms when home, myself and the other parent moved the 2 girls out to a new complex. We tried dealing with the management company, but they said they don't get involved in domestic issues. They will be happy to help if all 3 girls sign the termination paper work. You guessed it, the problem roommate won't sign. She is demanding we pay her $1000 + moving expense and she won't pay any of the costs of breaking the lease in order to sign the paperwork.
My question is do we have a legal ground to stand on to get out of the lease if she's doing illegal drugs in the apartment? The girls didn't know to file police reports when the other things happened so there are no police reports. She paid her portion of the rent late last month and they got a eviction letter on the door, but she paid at the last minute and they are paid through this month. The power is in her name and even though we paid her what she said we owed, she didn't pay the bill and let the power get cutoff last month.
