My question involves a traffic ticket from the state of: Illinois
I received a ticket for an "Improper Lane Usage-Violated Median"
I was trying to make a left hand turn at the intersection of E Dundee Road & N Rand Road.
As I approached the intersection, the line was extremely long to go straight--so much so that I could not enter the left turn lane without crossing over a very large double yellow striped line area so as to get into the left hand turn lane, which was empty. I was immediately pulled over (as if they were watching this intersection very closely) & cited for "Improper Lane Usage-Violated Median."
When I spoke with the officer who pulled me over, I told him why I had done what I did, namely because the left turn lane was empty & the line was so far back to go straight. He said "I know. A lot of people do this & we've been told to watch this intersection, due to a lot of accidents here." He went on to say that "A car could have pulled out of the straight lane at the last minute & moved over to the left turn lane, which could have resulted in an accident." I told him that if I saw a car doing that, I would have yielded to them, as I would if we were traveling down the road." It didn't matter to him, & I received a ticket.
My license wasn't taken, & I was told about a DIVERSION program, so that it wouldn't go on my driving record--but I had to plead GUILTY & still pay a $166.00 ticket.
My question is, do I have any ground to stand on this in court?
