Speeding Tickets: Is it a Ticket Defense if an Officer Tells You He Would Have Let You Go

My question involves a traffic ticket from the state of: California
Hi all,
I was speeding down the hill from Lake Tahoe when my friend screamed there was a cop on the opposite side of the road facing us. I did the stupid thing, slammed on my brakes. As I was going by him, no lights turned on. He was looking at me, but still, no lights came on. I went down the road, looking in my mirrors to see if he had turned on his lights and he never did. Fast forward around 5 miles down the road. I was coming up behind a car in a 55mph speed limit zone, but since we were going around turns, yellow caution 30mph signs were posted. I was coming up behind him a little fast as he was probably doing around 25 - 30, so I slow down for a good quarter mile before he randomly slams on his brakes, coming to almost a dead stop in the middle of the road!! This causes me to obviously slam on my brakes to stop from hitting him. He, without signaling, got off to the right side of the road and I kept going. As I went around that turn, I saw the cop with all his lights on behind me.

So cop pulls me over blah blah blah. He has me get out of the car and tells me that I "ran that guy off the road". :confused::confused: I was so confused I didn't know what to say, and don't like arguing with officers. I asked if I was going to receive a ticket, to which he laughs and says "Yes, you were going 78 in a 55." No argument there, I know I was speeding. But then he says "If you had stopped when I first saw you speeding, I would have let you go." This is where my problem with this whole case is. I would have stopped in a heartbeat had he put his lights on when I saw him first. I would never think about running away from the law, but he didn't have his lights on! I know he has a dashcam, because he had me look into it when he pulled me out of the car.

Point of this thread - can him saying he would have let me go be a good reason to go to court and fight it? I want to see the dashcam footage of what he saw when I "ran that guy off the road" as well, because that is definitely not what happened. The fact that he didn't turn his lights on when he first saw me bothers me also, because I've seen a lot of threads saying that the dashcam doesn't start recording until their lights turn on - making it possibly look like I was trying to run away or something.

Any thoughts?

On a good note, I was standing with my arms in front of me - in clear view - as he was talking to me about the ticket. He asked "Do you need to pee or something?" I replied, "No, but in all honesty, I kinda have to poop." He doubled over laughing at that :) All due respect, the cop was a really nice guy, I just don't think he did his job correctly when it came to him stopping me.
