My question involves real estate located in the State of: FLORIDA. We have a retention pond in our back yard that backs up to several homes. The HOA currently takes care of property around the pond including the pond itself as it purpose is to collect run off water of the streets. During Hurricane IRMA the pond could not handle the amount of water from the streets causing the levee to break on the rear side of the pond causing the water to drain out off the pond. The HOA now contends that since the break in the ponds levee is on my property technically it is my responsibility to pay for fixing it which would cost me a minimum of $15,000. The pond is there for the sole reason of the state requirement for water run. I don't get any rent or income for this pond being on my property and now I'm excepted to pay for it. Is this really my responsibility to pay for the repairs? They paid for removing a tree that fell into during the storm but are putting the burden on me to fix the levee.
