My question involves criminal records for the state of: New York
In 2014 I was convicted in NY of DWAI. I have no criminal record in the state (DWAI is an infraction). However the arrest and sentence shows up on my FBI Background check.
What is the possibility of having the DWAI Sealed? Do I need to wait 10 years?
I know that NY now allows felony and misdemeanor convictions of more than 10 years to be sealed under the the new law CPL 160.59. I also know that DWAI's were not sealed under CPL 160.55.
I am attempting to get a resident visa in a foreign country and a FBI Background check is require. Therefore the arrest is a problem.
