My question involves landlord-tenant law in the State of: Texas
Posted below is a message I sent to the City Attorney that describes what is going on. I would like to add that I received no training on reading meters and I was reading the meter assigned to my slip. I have been given insufficient time to locate a another slip, as this is a process that takes time. I have not received a response from the CA as of yet. I did receive a call from the City Mgr. that I need to "pack up my boat and move". This after he talked to the Marina commissioner who has a history of disliking liveaboards and making wild and sometimes slanderous accusations. The City Mgr. made this statement purely from the Marina Comm. accusations without reading or listening to my side. Be advised that my boat is in pristine condition and is used regularly. Please read below and if anyone thinks I have any recourse please respond.
This was sent to the City Attorney and the City Mgr. Jimmy being the Marina Comm.
All,
I am reaching out to you in order to communicate my desire to remain in the Marina on Pleasure Island. I have recently received an eviction notice which will seriously affect my life, job, and well being. As the instance would be warranted if intentional, I wish to ensure all that it was completely unintentional.
My wife and I have been living aboard our boat for almost a year. I gained live aboard status after applying through the #### #### Yacht Club of which I hold the office of Secretary. Being the first live aboard since the reconstruction of the marina and hearing the horror stories of the types of people Jimmy ### had to deal with, I didn't want to be a burden to the PIC employees. I offered to haul away my own trash in order to minimize my impact on PIC, but was told that it would be fine to use the marina trash bins as long as I did not generate an excess amount. I also generated an Excel spreadsheet that would tabulate the KW hours and cost per hour to give a total cost of electrical usage. I submitted this sheet and it was accepted after I suppose PIC reviewed for accuracy. I would read the meter and feed this info into the spreadsheet, then send via email to the PIC office and my bill would be generated. The incident that has raised the question of my integrity is entirely my fault. The shore power pedestals which supply the power to the slips contain two receptacles; one 50 amp and one 30 amp. My boat requires the 50 amp while the boat next to mine uses the 30 amp. The 50 amp is on the opposite side of the pedestal from my boat, this causes the cords from the boats to be crossed and with the addition of the excess cord and the water hoses it is somewhat confused. As I stated earlier it is entirely my fault for the confusion, but I started from the beginning reading the meter on "my" side of the meter and not the opposite side where my cord was plugged in. The total KW hours I was reporting to the PIC office were in fact from the usage of the boat next to mine. Never having lived on a boat before, I didn't know what kind of electrical usage to expect. After several months Jimmy realized something was amiss with the total. After investigating, it was brought to my attention that I had been giving the wrong readings. At this time , I went to Jimmy's office to explain and offer compensation to alleviate the cost discrepancies. After speaking with Jimmy, I was told that it had already been turned in to the City Attorneys office, and that maybe it could be worked out at that level. I write now to do that . I will do what is needed to square away any discrepancies immediately as was offered before. I can't apologize enough for this , the question of my integrity is most disturbing to me. I am, and always have been honest and trustworthy. If needed I can supply references that will attest to that. I have treated the marina as if it was my own in regards to the well-being of the boats and ramps to the docks. During storms I patrol the marina monitoring the boats and retying lines or replacing them in order to keep everything secure. During the last storm I shimmed up the ramps in order to stop damage to them when the water subsided.
please see that this was purely unintentional and was an accident that I'm willing to recompense in order to stay in good graces with all involved.
