My wife and I recently purchased a condo that has condos above and below. One day after running the shower/tub, my downstairs neighbor came upstairs, introduced himself, and told me that water had started leaking directly above his bathtub through the ceiling (my bathroom sits on top of his). He told me that this had previously been an issue a few months prior but that a HOA employee had come by and claimed to have fixed the problem. Because our condo sat empty for months prior to our purchase, there was no way of confirming the fix.
In the HOA Bylaws, it states "A unit shall also include any pipes, wires, air ducts, flues, conduits or public utility lines or installations serving only one Unit, but shall not include any pipes...serving more than one unit." The bylaws also state in a prior paragraph "the lower horizontal boundary of the unit is defined as the concrete floor."
My question is basic: is this my responsibility to have fixed because it originates from my tub, or is this the HOAs responsibility because the pipe is outside of my Unit?
