HOA and Enforcing the Covenants

My question involves real estate located in the State of: North Carolina.

Our previous HOA director (appointed by the declarant, before our current board was elected), gave permission for a homeowner to build a shed on their property. The covenants day that all sheds and detached buildings are prohibited.

Am I correct in assuming that should not have been allowed without amending the covenants?

What responsibilities does the newly elected board have in this situation, should they enforce the covenants and notify the homeowner of the violation or alternatively see if an amendment could be passed?
