My question involves malpractice in the state of: FLORIDA
I am POA for my 77-yo mom who was in nursing rehab due to failure to thrive at home. On first day at nursing home, they changed her from oxycodone 7.5/325 TID to hydrocodone 5/325 q6h prn with no explanation. She was in constant pain in nursing home (pain level never below 5-6) unless sleeping. She was in rehab for 17 days. On day of release, I had to work and had my daughter transport her from facility to Pain doc appt to home. During that visit, the pain DR did not see her, even though she requested to see an actual doctor because of pain concerns and alter in medication. Pain was under control prior to rehab stay and medicine change-up. She was told the nursing home said she did fine on the hydro- and refused to let her see the doctor (or the doctor refused to enter the room, I wasn't there). After getting her home, her pain level stayed increased. The nurse suggested I make another appointment with pain doc and did so only 2 weeks into her 30-day supply of meds. She is currently at home and under home health care following rehab. I had to work today and again my daughter drove her to the appointment. This time, she did she the Dr and she asked that her meds be returned to what she was only before rehab and they told her NO; since the nursing home said she was fine there, she was fine now. Mother did not take that very well and told them she could take 2 of they hydro- and they would still do nothing for her and asked again that she be returned to her former oxycodone (different from Oxycontin). Somehow they misconstrued her elderly confusion and upset with the fact that she had taken all of her medicine and was there for a refill 2 weeks early. Her initial Rx was 120 pills for 30 days and after 15 days still had 60 pills verified by the home health nurse in writing. She was given a form letter stating "..we have exhausted our available treatment options for your care. Your discharge from our practice will also release you from narcotic agreement with our providers." How is writing a prescription exhausted!?
Can they do that?? Just stop seeing an elderly patient who is in constant pain when they haven't broken any of the rules?? All of her urine samples have been normal. Her pain meds are accounted for. Her history is bilateral knee replacements, bilateral femoral fractures, rheumatoid arthritis, OA, she is wheelchair bound/bed bound unless 1-2 assisting with walker for 5 steps at a time. Sure I can get her another pain doctor, but there are but so many who take her insurance and are local. Is there anything we can do legally?? They gave her no warning, no phone calls to family, no education about why her meds were changed and actually told her she was a felon! Mom told them if they thought she was a felon, they should have her arrested. Instead, they fired her as a patient. Thank goodness she has a few meds left to lean on until a new doctor/appt can be made but the problem of PAIN was not addressed and they did nothing for her! WHAT CAN WE DO? How can a pain doctor just kick an old lady in a wheelchair to the curb that way? This is my first post and I want to shout from the rooftops the name of this doctor and the clinic that did this to her but I don't know the rules here yet. Heartbroken for mom.
