Determination of Fault: Insurance Company Repaired with Used Parts That Failed, Resulting in Loss

Had accident, where in transmission was broken. Insurance company repaired with used transmission, that failed,twice. They picked it back up, dealer recommended new transmission, due to the complexity of the hybrid. Insurance company installed a second used transmission, resulting in explosion, and fire destroyed car on the interstate. Sueing in small claims, and insurance company submitted notice to dismiss.
are there any case law's for similar circumstances?
