My question involves malpractice in the state of: Texas
I am 17 and I am a senior in high school. When I was 12, just after starting 7th grade, I was diagnosed with an inguinal hernia after a routine physical checkup. I was scheduled for an Inguinal Hernia repair in September of 2010. I get the surgery done by a supposedly well-respected surgeon in the area. After my surgery, me and my mother were told that everything had gone 100% perfect. I notice that there is a small, very tender to the touch spherical object in my sac. At each of the three following checkups, the surgeon tells me that I am fine. Everything looks good. When I bring up the small, tender object, he says that it is just a small sac of fluid that resulted from the surgery, and that it will go away in the following weeks.
The small sac of fluid didn't go away. Instead, it very slowly receded back into my abdomen. It is around this time that I notice there is only one teste in my sac. But I didn't know any better. I was a dumb little middle schooler. The doctor said I was fine, and so I just told myself I was fine. I told my mom a couple months after the surgery, that there was only one teste when there should be two, and she just blew it off. I don't know why, maybe because she liked to believe the well-respected surgeon instead of her barely educated son.
So I basically shrugged off the issue until just recently, when I finally put it all together. I made my mom schedule me an appointment for a physical (after numerous attempts). My physical was on Friday. The doctor told me everything I had already known (due to my research on the issue). I appear to have one testicle, and the Hernia repair should not have interfered with my testes, unless the blood supply to one of them had gotten cut off during the procedure, which would have caused one to shrivel up and recede back into my abdomen. EXACTLY WHAT HAPPENED. Keep in mind that I was born with 2 functioning healthy testes. My mother, nor I, were never told about any resulting complications following the surgery, so I should have two now.
This has to be medical malpractice. The doctor told me that the sac of fluids was just going to go away with time. In reality i believe he had made a mistake during the surgery, cutting off the blood supply to one of my testes. In order to cover his own ass, he told me a bullshit reason to explain the tender spherical object. My mother was out of the room at the time, because he was looking at my private areas and I didn't want her in the room. She was told that I should have had 2 testes and that the procedure went fine.
Does this sound like Medical Malpractice to anybody? Something has to be wrong here. I need to know if I should schedule another appointment with the doctor, or go straight for a lawyer.
