My question involves labor and employment law for the state of: Washington
My husband works full time for a company at an hourly rate for the last 5 years. He was informed today that his position has been eliminated and they are offering him another position within the company for a $1 less per hour but recieveing sales commission.
He has expressed numerous times that he does not want to work in sales and does not feel qualified to do so. We feel this is their way of laying him off/getting him to quit so that they don't have to pay unemployment.
My question is, if he rejects this new job position and pay change, will he be considered laid off and eligible for unemployment? Could he justify turning down the new position because he feels underqualified and is taking an hourly pay cut (especially since commission compensation can vary so greatly)? He feels he is being set up for failure in this new position... thanks.
