Speeding Camera Civil Citation

Hello,

In September of 2017 I received a Civil Citation for speeding from Newburgh Heights Police Department, a village in Ohio. A speeding camera had taken a photo of a car registered in my name going over the speed limit. I decided to contest the ticket via their process with their “Hearing Officer” which seems to be an attorney on retainer from somewhere.

Anyways, at my hearing, I presented a witness statement document I made signed by three people who are willing to testify I was in their company at a store during the time of the citation, not driving. I also pointed out that the photo evidence from the camera also doesnt show any clear photo of a driver (night time, completely dark). The hearing officer asked me to identify who was driving and I refused by saying “I dont know, nor am I legally obligated to give that information.” He was flustered with that response and then said the witness statement was persuasive but not good enough and offered to drop the fine to $75. Since I was not driving, I refused the offer and in return, he cranked the fine back up to $150 and said my only recourse is to either pay or to appeal with Garfield Heights Municipal Court.

He, nor the clerk for Newburgh Heights provided any information on how to go about initiating this appeal process. I have no idea what to do procedurally. I even called Garfield Heights Municipal Court and asked them how to initiate the appeals process and the clerks assistants response to me was “we cant give legal advice.” I stated multiple times Im simply asking procedurally how I appeal. How do I do this? My defense is so clear cut, in my opinion this hearing officer abused his power, but thats besides the point.

I cannot afford an attorney.
