Hiring: New York Civil Service

My question involves labor and employment law for the state of: New York

I don't know if this is the right sub, but here goes.

Last year, I interviewed for a provisional position at a local community college. It being provisional was fine because I did not have a job at the time.

I did not get the job and someone else got hired. I could also understand why they went with him in the first place - he had some more experience in one area than I did, so he'd likely do well on the test (He got a perfect score). If he ended up failing the test, they at least got 9 months of work out of him.

I ended up taking the Civil Service test when they offered it and I passed.

I ended up getting canvassed for the same job at the same college. I said, what the hell and put my hat in the ring.

I had the interview this morning and they said I was the only one on "the list" to apply and they were also talking to off-list people.

Here's the question I have...

If someone on "the list" is weaker than someone off-list, is the preference to go with the on-list person, within reason on course. In other words, if the folks on the list are deemed "good enough," are they given preference since the college won't have to do a provisional assignment and wait until the next test?

The test in this case is a training & experience one.
