My question involves a child custody case from the State of: NJ
My ex husband ans I were divorced in 2014. We've been back go court once or twice a year for various things because he does mot follow the divorce decree.
A very long story short....over the summer my then 15 year old son was at his house. My son was trying to explain to my ex about an upcoming trip to California. My ex started ranting about me, much to my son's dismay. My son told him to stop. My ex yelled at him and put him in the corner. My son had had enough and ran away from his house. I went and got him. My son has not been back since. My son is in therapy. He goes bi-weekly. My ex has been told by my son's therapist to seek therapy, and when cooler heads prevail, the two of them with their therapists can start working on things. My ex never went.
My ex did not do Christmas with my other two children (14 and 18) and blamed my son for it. My ex sent my son a text for his birthday, the first communication since august, and my son laid into him. He was legitimately still hurt and angry at him for his Christmas nonsense. I did not agree with my son's reply. It was very harsh.
A week later my ex emails me and tells me he is taking me back to court to emancipate our 16 year old son and he is suing me for my direct involvement in his behavior.
I'm sorry....what???
I have dome nothing but encourage my son to go with his dad, even just a quick dinner at a public place. I take him to therapy 2 towns away. I do not force him to go, because my son has valid reasons for not wanting to go....years of sustained emotional and physical abuse.
I do not have the money for an attorney. I do not think that emancipating him will help their situation. In fact I feel like my ex doing this puts any chance of them reconciling in the trash. Who disowns their kid?? Can he even do this?
I know that because of his age that won't be held in contempt. The police came and took a report and he said on camera, "If you make me go, I'll just run away again."
I really thought my ex would have made an effort and gone to therapy so he could fix things. Now he is taming my other two kids on their first family vacation since the divorce, to Italy....and he's taking my son and me to court.
What do I do? Does my son get a guardian ad litem? How do we do that??
