My question involves landlord-tenant law in the State of: Florida
Long story short:
-signed 1 year lease May 1, 2016 ending May 1, 2017
-contract had the option A box checked (early termination/liquid damages fee) and we initialed agreement.
-December 2016 we notified landlord we would be moving on March 6 and offered to find a tenant. He agreed this would be ok.
-March 6 rolls around and we move out.
-March 7 new tenants move in
Questions:
1. Since contract was technically terminated, is he still required to send us the certified notification regarding deposit?
2. Since he found a tenant and didn't lose income, can he still charge the termination fee?
I am asking because we asked about getting our security deposit back earlier and he said "it wasn't guaranteed". I'm not sure he is aware of the 30 day certified notification regarding the deposit, or if it's even required since the lease was terminated, but if he doesn't notify me within 30 days I don't want to bring up the 30 day notification statue and he turn around and asks for the $3600. I'd rather lose the deposit and never talk again then try to ask for my deposit and he come back with that statement.
