I'm New York State.
I'm curious if it's worth contesting a no Headlamps ticket I received.
Tonight, I got an oil change and a brake inspection. Immediately upon leaving, I rear ended another car when my brakes failed to engage. A mechanic I talked to said that they pushed the pistons thru to check the brakes and likely did not prime them again, causing the first few pumps after that to not engage.
Upon a cop showing up he repeatedly asked me if I was "sure I wasn't just distracted". I offered to show him my receipt dated less than 5 minutes before the accident, but he could care less. At the end of the incident, he wrote me a ticket for headlamps not being on. When I questioned it he threatened to give me a ticket for "following too closely" and "failing to stop" as well. So I took the ticket.
I'm fairly certain he just wanted to ticket me for something since he assumed I was lying about the accident. My headlights have never been switched off since I bought the car. They turn off automatically upon locking the car, and back on when started.
Being that he was not at the accident at the time it occurred, nor witnessed my car actually on, would I have a reasonable case? Or would the court just believe whatever story the cop told and thus is a waste of time?
