My question involves a child custody case from the State of: NY
My daughter is 19. She goes to college in AZ. When she is home on breaks she is living with me. Her mom moved to FL last July (2015). She visits her mom for a few days at a time and when she does she doesn't stay with her. She stays with her Aunt. My daughter doesn't like her mothers bf and refuses to stay in the same place as her. Anyways I have been sending her mother child support ever since we divorced (almost 5 years). I went to two lawyers and asked about getting support to my ex stopped since my daughter doesn't live with her anymore and hasn't since last June. She lives with me. Both lawyers said its a pretty easy process of going to the family court and filing a petition of termination. Which I did this week. My daughter has asked me to take over her medical and cell from her mom which I will be doing. So I explained all this to my ex that I had filed a petition of termination and explained to her that I will be taking over paying for our daughters medical and cell and I will be sending money to her directly each month instead of it going to my ex. Well my ex sure didn't like that idea. She informed me that I cant have support changed just because our daughter doesn't live with her anymore. I said well according to the law and the two lawyers I spoke with I can. I also told her that both lawyers told me I was entitled to support from her (which Im not asking for). She thinks I am the most evil person alive now. To be expected because she was loving the extra money she was getting each month. My question is how long does it take the court to modify the support once I file and should I continue to pay the support (we never went thru a family court before for support. we wrote up our own agreement)
