Finally a question of my own.
I am a homeowner- original owner of a home on a corner lot. Next door neighbor moved in a few months ago. The shared fence between our two properties is rotten and deteriorating, and sections are beginning to fall into my yard.
It was built by the original homeowner of that house. We added our own fence several years later to enclose our yard, attached to his, with his permission and noted on the permit.
Not 100 percent sure now if the fence is on the border or just inside his border. New neighbor is rebuffing attempts at conversation about remedy. He seems to think that if he ignores the problem, it'll go away.
I'm not sure how to proceed next. I'd like to replace the fence, or even build my own on my side if he continues to blow me off. I have read that shared fences in VA are the responsibility of both homeowners.
Should I get a new survey first? And what do I do with the downed fence sections? We'd been nailing them back up, but the fence is just too rotten to sustain.
