My question involves personal property located in the State of: NJ
In 2009 we bought a 2 bed room condo in NJ. It had 2 assigned parking lots. Since 2015 we rent out the whole apartment including 2 parking lots. Today we just got call from our neighbor telling us that the condo manager re-painted the numbers of all parking lots. He added one lot for office use, and reduce one from ours. So our 2 parking spaces become 1! This is happened without any notice. And our tenant is not home these days, so they have not know yet. This condo has 38 apartments, only we have this problem. In our condo every 1 bed room apartment has 1 parking space, and 2 bed room apartment has 2 parking lots.
We did not find any condo closing documents which specified parking lots. But we do have renting leases which specified the 2 assigned parking lots were included. The leases were proved by condo manager.
When our tenant knows this. we become violate the lease.
Our question is, we have the parking lot rights, or condo has? condo manager's action is lawful or not. How to get back the parking lots. Please help.
