Maintenance and Repair: Special Assessment for Road Maintenance

My question involves real estate located in the State of: California

According to my road maintenance agreement, the president of my road association has the authority to “assess owners additional payments when there is not sufficient cash in the general fund to meet repair costs, when a majority of owners approve additional assessment.” These special assessments are happening every year because the agreement was made many years ago and according to the agreement, everyone pays only $100 as a yearly road maintenance fee.

Can the president access difference amounts to each property owner if the general road maintenance is otherwise shared equally? It seems wrong that people are voting for work that they don't even have to pay for.

A real estate legal dictionary defines an assessment as “a specific levy for a definite purpose, such as adding curbs or sewers in a neighborhood. Individual property owners are subject to special assessments benefiting the project as a whole and not funded through regular maintenance charges.” As such, I don’t see how it is fair to access different amounts to each property owner. Apparently the road association has been doing this for many years, but I just bought my property recently.
