My question involves landlord-tenant law in the State of: California
Hello,
My co-tenant and I just finished our 1 year lease agreement and are now on a month-to-month agreement with the same lease. Co-tenant has been traveling out of the country for several months and is now telling me she plans to bring back a man she met to stay here with us for three months. I have told here I am not comfortable with this, least of all because she is telling him he will not have to contribute anything - including rent. Her argument is that she pays rent and should be able to let people stay in her room. Per our lease agreement, "Occupancy by guests for more than ten days in any six-month period is prohibited without HP's written consent and shall be considered a breach of this agreement."
For several other reasons, I would like to have her removed from the lease agreement. However, I would like to continue my residence here. I would like to approach my leasing agency and landlord about this issue, but am fearful of being held responsible in some way. I understand that since we are both signed on as co-tenants that we may be viewed as a single entity responsible for rent and other obligations. However, I have a good rapport with our landlord and feel that he may be willing to work with me on this. If I forewarn him of this impending circumstance, and if he is sympathetic, is it possible for him to take action against only her while sparing me any sort of reprisals?
Any insight is very much appreciated.
Thank you,
John
