Hi my question is about a RV camper that I have at a seasonal site in Upstate NY. The campground was suppose to open May 1 2017 and because it is on the lake and it flooded we were unable and still can't open our camper. 3/4 of the campground - there are 120 sites are still not usuable due to the flood and lake levels still too high. I paid a site fee for the season and signed a contract however I have not been able to use my trailer and can't pull it out due to mud but now it has dried up but the damage that the water and they put sewers in each site and tore up my site with ruts and ripped trees down. I can't walk on my site as it is not even and have big ruts. It is really dangerous. The owner also put sewer pipe in and didn't cut the pipe down so I can't pull out my slides to even open my camper. The campground owner is still expecting us all too pay the full site fee $1875 even though we would only be able to use 2 months if lucky. I have put half down as my deposit from last year. I have tried to reason with the owner and they won't budge. I want to pull my camper out now as it has dried up and move it to my house. The owner states that she will pull my trailer, put it in their field and I can come pick it up when I pay the balance of my site fee which is approx. $1300. Can they hold my trailer hostage until I pay? I just need some legal advice.
