My question involves restraining orders in the State of: California
Hello,
I dated a woman off and on over a period of several years. It was never a serious relationship, nor did either of us express any desire to make it into one.
Eventually, I met my current wife (back in 2012) and broke contact with the woman I was casually dating, and never heard from her again... until recently.
After dating for over 4 years, my wife and I were married in 2016. Shortly after our marriage, we both began receiving violent, vulgar, and extremely obscene emails from the ex I had casually dated. I was shocked, as I had not heard from this person in years, and figured she had moved on and was probably also married or in a serious relationship.
I replied once, AND ONLY ONCE, telling her to stop the harassment or I would file for a restraining order. That stopped her for about 3 weeks. Then the emails started coming again...this time escalated, being sent daily, and even more disgusting and disturbing. She sent hundreds of images / videos of people eating feces, having sex with animals, vaginal repair surgery, references to serial killers, and so on. She sent dozens of messages insulting my wife's appearance/weight, and included VERY old pics of my wife where she was overweight (she has since lost the weight). We have no idea where she got the old pics of my wife.
In addition to the emails, she has signed us up for pornographic magazines and had them sent to our residence (and even my parents house). She has used our name and email addresses and signed us up for weight loss consultations, fast food restaurant mailing lists, vaginal surgery and mental health consultations, and so on. She even created a fake dating website profile using my name and contact info.
After 6 months of this abuse, it was clear that ignoring her was not going to work. So my wife and I filed for a restraining order. A judge reviewed the evidence and granted a hearing date and a temporary order.
My ex tried her best to evade being served the papers. I spent hundreds on process servers / investigators to track her down and get her served, and eventually it paid off.
Now that she has been served, the emails have stopped. However, I believe she has no intention of letting this go, is now out for revenge because I filed on her. On the restraining order forms, there is a field where the respondent (my ex) can state why they feel the order should not be granted. She wrote a LONG rant, claiming that I mentally and physically abused her, and even date raped her.
My wife and I are worried that she will go the police with these false allegations. There is no physical evidence of course, however I *do* have ONE SINGLE criminal conviction in my past for a violent felony. But no other criminal history. In addition, I'm college educated and work in a scientific / professional line of work.
So that's my situation. The question is, given these circumstances would the police/prosecutors possibly believe her and decide to press charges against me? Would the restraining order and emails, and the fact that she's making the allegations AFTER they occurred, be enough to prove she's lying and prevent police / DA from looking into the matter or filing charges?
