STBx and I are disputing over visitation times. The court order originally said I get child on Mon and Tuesday, Stbx gets her Wed and Thur, then we we split the weekends. We both decided that was not a good fit and verbally agreed that stbx would keep child during the week. I would get her every other weekend plus Sundays for approximately 6 hours on her weekend. During the last month, she has become very physically aggressive and sometimes violent when I go to pick up child. Last time I was there, she chased me to my truck and started slapping the windows while I was trying to leave.
Since then, I told both her and her attorney I will not pick up child from her house anymore due to safety concerns. I suggested the local police departments online exchange area, but acquiesced to other neutral locations with video surveillance. Stbx is refusing anywhere but her house. She no showed yesterday twice on our verbally agreed to Sunday and she is threatening to no show again tonight to the court ordered time (No location was ordered).
Should I file a parental kidnapping (or interference with a court order) charge against her tonight?
