My question involves a traffic ticket from the state of Michigan:
I received a civil infraction over the Memorial Day weekend for my vehicle having tinted driver and passenger windows. I've had my car for 5 years and purchased it from the dealership, so I had no reason to think that they would be allowed to sell a vehicle that would be in violation of any vehicle laws. Apparently, the way that the ticket was issued, a 257.709, it was classified as an un-correctable violation which has a $95 fine and 2 points on my license. The officer even told me that I could go home and scrape the tinting off of my window, which I wasn't even aware up to that point that tinting was just a stick on sheet, I thought it was a special window treatment. I'm not arguing that I wasn't in violation, I just wasn't aware that I was in violation and had I known I would have had it corrected a long time ago.
Anyway, I called the court to have clarification on my options, which there are normally 4: Accept Responsibility- pay the $95 and get the 2 points. Accept Responsibility with Explanation- submit a letter why you should have special consideration to possible remove the fine but not the points. Deny Responsibility- gets a hearing to discuss in front of a magistrate. Correct the Violation- fix the violation and have another officer sign off to waive the penalties.
Unfortunately the way that the officer filed the ticket the "Correct the Violation" option is not an option, which in itself I feel is unfair and wrong given that the officer even told me how to correct the violation. I'm having the window tint removed, if the dealership would have told me when I purchased the vehicle that it would be a problem I either would have had it removed 5 years ago or would have looked at another vehicle. I'm here because I'm trying to figure out what to do between Accept with Explanation or Deny Responsibility and hoping that someone can give me a non-bureaucratic explanation between the two options.
If I Accept Responsibility with Explanation after showing that the tint has been removed I MAY not have to pay the fine but the points will still be applied to my license, but if I want to attempt to not have the points applied I would have to Deny Responsibility. Is this correct?
