My question involves criminal law for the state of: PA
I live in a not so great area in PA, and sometimes my job takes me to even less great areas. While I don't nessecarily go to TERRIBLE neighborhoods frequently, I am still concerned about being attacked while out in public. I also am a pretty opinionated person and I've probably pissed some people off in my time based on stances I took on certain issues. Suffice to say that I don't always feel 100% at ease while out in public. I don't think I want to go through the trouble of gettIng a concealed weapon permit, although I don't think I would have any issues getting one as I am legal, sane and have no criminal record. But the costs and risks of gun ownership are very high. So I considered getting some pepper spray to keep with me when I'm traveling around.
My question is this, what circumstances would have to happen for me to legally use it to defend myself? For example I was walking home the other day and some people were ahead of my on the sidewalk. I crossed the street to go towards my parking lot and when I crossed the streets the two people that were walking towards me must have thought I was trying to avoid them and they made aggressive taunts and statements to me. I did nothing in return but kept walking to the parking lot. I could care less what some passing strangers say, but suppose one of them cross the street continuing to say aggressive statements? If I had pepper spray could I legally use it in that instance as someone walking towards me is saying they are going to kick my ass? What if they weren't saying anything just coming up toward me with an angry look but no specific stated threats?
There are also times I am out late due to work. A few weeks ago I was going to my car in a parking lot. 4-5 people were walking towards me and one of them said "let's get him". And they all started running towards me. Then they stopped about 25 feet away and laughed and started running the other way. So it was a joke for them, but holy crap my adrenaline was rushing! I thought I was about to get jumped! So what if they weren't joking and I pepper sprayed them when they got nearby? Suppose they didn't intend to kill me but they scared me into thinking they were going to do bodily harm (life is not a chuck Norris movie, 1 guy probably isn't going to do so well fighting 3-4 young adults) would pepper spray be legal then?
Finally also for animals. Sometimes when summer comes I like to take a jog through the neighborhood. One time I got chased by a dog who wouldn't stop chasing me even after his owner was calling him. I basically put ran the dog who got winded and turned around and went home. I screamed at the owner "you better get this dog under control!" But he didn't say anything. Could I have pepper sprayed the dog?
