My question involves a driver's license issued by the State of: PA
I had my license suspended as part of my DUI ARD terms. It was a 60 day suspension, and I surrendered my license products to the court/PENNDOT. They received it all and my credit started the day of my ARD court.
I went online and paid the license restoration fee as soon as I could (I was checking every day once the suspension started). The last "Restoration Requirements Letter" I pulled from the PENNDOT website listed only one condition: the 60 day Term of the suspension.
Today I went to pull another letter in case there was something added to it or whatever (there was no mention of proving Insurance, which I've read elsewhere). Just trying to cover my bases. Anyway the website said: "Error: At this time, there are no restoration requirements to view/print." I called the IVRS at PENNDOT (it's after business hours), and selected the option to check my license status. To my surprise it said the status is "Valid." It had definitely been Suspended earlier, and my term is not up yet (but it is approaching).
So I have two questions:
1. Is it normal for PENNDOT to update their system to show my license as valid some days BEFORE the eligibility date they had provided on my previous Restoration Requirements Letter?
2. I understand that not having my license in my possession while operating my vehicle would constitute an offense. *IF* I were to operate my vehicle and get pulled over, would the officer see the same information that the PENNDOT system gave me through their IVR system? Really I want to know what sort of action the officer would take: give me a summary citation (as if I'd forgotten my valid physical license at home), or arrest me (as if I had been driving on a suspended license)? Because of the probation that comes with ARD, would I be at risk for losing my eligibility if the officer simply gives me a citation? The terms of my probation say I can't be arrested, and I'm assuming I wouldn't be arrested for forgetting my license at home, as long as PENNDOT lists it as "valid". Is this a safe assumption?
Basically, I'm itching to drive!!!! I love driving (sober!) so much, and also it'd be great if I could stop paying the costs to get to work without a valid DL, and save a few bucks here at the end of my suspension. I'd be willing to risk a citation (although I am a safe driver, and I keep my vehicles well maintained, so I think the risk is minimized), but I would NOT be willing to risk an arrest, loss of ARD, and subsequent conviction.
