My question involves a consumer law issue in the State of: Wisconsin
I signed a purchase contract on a vehicle with a specific option package and VIN number with the understanding it was on the property of their sister dealership (same company) about 40 miles away and would be delivered today.
After arriving at the dealer today they informed me that vehicle was already sold, but they used a locator service to find an identical vehicle option package, and it would be about 5 days to arrive.
For reasons I wont get into here, I believe they were not necessarily above board with this from the beginning, and I am having concerns about doing business with them.
I put $1,000 down in the form of a check when the sales agreement was signed.
As I see it, the contract was for a specific car (VIN listed on contract) at a specific location - not any vehicle with a specific option package - and that the contract is null and void at this point...in which case I would be entitled to my $1,000 back without penalty.
Is this an accurate assessment, or am I still contractually obligated to purchase the replacement vehicle from them?
