Business Regulation: Non-Medical Home Care and HIPAA Compliance Requirements

My question involves business law in the state of: Michigan

Hello,

I run a non-medical home care agency, where I have aides go out to privately paying Clients homes and assist them with their daily needs. To date, I have all my Clients fill out my agreement paperwork with a good old paper and pen which ends up in a locked filing cabinet. That paperwork contains the Clients name, contact info, and answers to a brief medical questionnaire. The medical questionnaire contains questions about their mobility status and inconstancy status.

To make the agreement process smoother I'm evaluating online document signing services like docusign. The issue I'm running into is services that offer a "HIPAA compliant" package are ungodly expensive. So naturally the question popped into my head regarding HIPAA compliance and my company. I've always assumed I'm required to be HIPAA compliant and have run my business that way for years but, I've never had an expert opinion on it. However, I'm reaching out today to ask the experts whether or not I'm required to be HIPAA compliant?

Lastly, regardless of whether or not I'm required to be HIPAA compliant, can I use a non-HIPAA compliant signing service for my Client service agreements?
