My question involves a traffic ticket from the state of: New York
Hello and thanks in advance for any guidance. I was issued a ticket yesterday after a minor collision for Following Too Closely. Here are the facts:
I was traveling down a road that splits from 1 lane to 2 lanes. Driver in front of me stayed straight (just right of the center line) and I shifted to the right lane as I was going to be turning right about a half mile down the road. Road is two car widths wide at this point and I am basically in what would be considered the drivers blind spot. Front left of my car is closest to right rear of his car.
He then abruptly makes a right hand turn, across the front of my car, without signaling, into a strip mall entrance and the front left of my car contacts the right side of his car (behind passenger door). To me, I felt like I was cut off and he was on the far left side of the a 2-car width road making a right hand turn.
Important fact that would aid his defense is that while the road is two car widths wide, the actual stripe marking the two lanes starts on the far side of the driveway he was turning into. Not before the spot we collided.
So when the officer showed up he asked us both if the driver signaled, I said no (which I really believe to be true, I wouldn't pass someone on the right if they were signalling right). The driver said that yes he did signal.
I was issued a ticket for following to closely.
Do I have any basis to defend following too closely? Obviously the failure to signal is a he said/she said. Does following too closely have to be a direct front to back type of collision (evidence clearly would show I was an entire car width to the right of the driver). Also the question of when the two lanes begins in the case when the road divides.
