My question involves real estate located in the State of: California, I did an interspousal transfer of our property to my wife making her sole owner of our home. I am the mortgage holder. She filed for a divorce and had a will done leaving the house to her son with transfer on death on the deed. I never responded or followed up on the divorce which did not take place. She passed away within two months of all this transpiring. Now her son is the sole owner and I have a mortgage of around 350000. The lender has no idea of the transfer of ownership on the deed as yet. I am not disputing, but what are the possible options that would lead to the best outcome for all concerned, I would like to feel I can relocate, but with the mortgage hanging over me it's a big issue and I don't know if he can assume the loan or would be forced into a payoff situation.
