My question involves a consumer law issue in the State of: West Virginia
I had a new detached garage built and the contractor who did the excavation offered to install the non-structural concrete floor in the garage. The contractor sub-contracted to another (later found out non-licensed) individual to do the concrete work. Within a month of install the concrete began to crack. I contacted the excavator contractor and he indicated he would attempt to repair by having another concrete company come in and thin-coat the floor. That was last fall, the contractor stated he needed to wait until the weather warmed up in order to do the work. Now, a year later he still has not done anything and the floor is getting worse. The cracks cover most of the floor, are about 1/4 wide, chunks are lifting off and the edges of the cracks are at two different levels. I believe the floor should be replaced but I am getting no response from the contractor. How bad does the floor need to be before I can sue the contractor for a new floor since it is a non-structural floor?
