My question involves a consumer law issue in the State of: california
Hi, My name is Brian and am new to the forum. so i am looking for advice on my current issue.
this is the story:
on 7/20/2017 i dropped off my car to the dealership because the car's battery needed replacement since it was dead and would't start up the car. days passed and received a call on 7/22/17 from the service department letting me know that the starter would also need replacement since it was causing the problem an addition to the battery, so i said it was ok to replace it aswell. on 7/24/17 the dealership employee gave me a call and said everything was replaced and worked great again. I went to the dealership on 7/25/17 picked it up and payed for parts/labor installation fee since i didn't have warranty. after receiving the car i turned off the engine then started the car several times, just to make sure everything was properly installed and was functioning properly. Everything seemed fine so i left the dealership service department and was heading back home which is about 1-2 hours depending traffic. after about 5-10 minutes of driving the car i suddenly heard a thumping sound come from the engine bay then quickly after the brakes locked themselves aswell as the wheels, steering wheel and acceleration pedal. i was scared as i thought i would crash with cars in rear. i was on a 50mph highway going 47mph but after the brakes were locked it quickly went from 47mph to 20mph. i could not control anything and thought i could potentially be in a serious car accident or even killed but thankfully the cars behind me were a good distance apart so when the brakes automatically locked themselves the car behind me had time to stop but i could not even imagine what would have happened if i was on the freeway or highly trafficked area going at 60mph or if their was a truck behind me and would not be able to stop in time. thankfully i was alright and called to tow the car back to the dealership. Once there i spoke with the personal at the service department. they told me since it was their fault for the problem that they would fix it and involve manager in this situation. my question is can i pursue a legal action of any sort?. i understand it is a mistake but that mistake could have costed my life. should i pursue legal action of some sort if i can or should i demand for compensation??. which would be best in my case???
