Other Violations: Clarification of Cvc23123.5 a

My question involves a traffic ticket from the state of: California

The vehicle code reads in part as follows:
"23123.
(a) A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving.
(b) A violation of this section is an infraction punishable by a base fine of twenty dollars ($20) for a first offense and fifty dollars ($50) for each subsequent offense."

I received a ticket for supposedly picking up my phone and looking at it while stopped in the left hand turn lane on a red light. I honestly don't remember doing that and I was not "driving" but was stopped. It doesn't say in the code that that is a violation but the officer said it was.

Also, they're telling me the fine is $165 even though this was the first time I've been stopped for any moving violation since 1974. The court is over 80 miles away and is a hardship to drive (about a two hour drive in rush hour traffic to be there at 8:30am) and even more of a hardship for me to pay the fine.

Just wondering how others would handle this - contest it, pay it, ask for it to be dismissed due to financial hardship?
