My question relates to legal practice in the state of:
My brother and I are co-owners and co-beneficiaries of a second home (a vacation property) that my family has owned for years. The house is in a trust, and we hired a lawyer many years ago to set up the trust and take care of all administrative issues and documents related to the trust. Many years have passed, and my brother and I are now estranged. He is currently taking legal action against me (involving the house/trust), and he's using the lawyer we hired together to do so. Is that allowed? It feels like an overt conflict of interest for the attorney. The issues with my brother are hard enough to deal with, but I also feel betrayed by the lawyer. If a conflict exists, what are my options? Can I file a complaint against the lawyer? File a suit?
Thanks in advance.
