If you read it you will see that I was told by everyone that my case was crap. Well, I settled the case for $215,000
Here are the exact facts that I had to make very small changes because the case was active and I was worried about them googling "electric bike and park or something, so I changed a bike to moped", but I believe all else are very close to the facts I wrote in the post, almost exactly.
I was riding an illegal electric bike with pedals in a park, more like an electric dirt bike. Regular bikes are not allowed in the park, so I must have pissed off this parks employee. This park employee decided to chase me in a car when he spotted me leaving the park. The parks employee was driving on the street at the time.
I knew on the street he was chasing me because he was yelling and driving erratic.
I rode back into the park to get away and fell and broke a bone. The parks employee actually drove the car right into the park on the grass chasing me inside the park.
Just by luck I had my action cam recording and caught the whole thing. I actually took off but got the parks department car in the video and it was numbered.
Case settled couple of years later for $215,000. I was scared that I would get in trouble because I was totally illegal but it didn't matter and nothing came of that.
What made my case was the video because it showed the parks employee on the grass, it also showed him getting out of his car and cursing at me, this guy was raging at me, LOL. You don't see anything behind me just in front.
Please read the post and read how I was told my case was crap because I was running, LOL which I was. So please take what you read here as good advice but please go see a lawyer.
This know it all dude in the thread should have known that if you are being chased by a car on the grass in a park and fall and break a bone, you are getting money. Even if you were doing something illegal and running away. Especially regardless if he hit you with the car or not.
What he should have said was that if a parks employee is chasing you with a car and you are on a moped and you get hurt, yeah you can most likely get a settlement. No car should be chasing someone on a moped through a park on the grass.
The bad advice that was given was basically saying that because I was doing something totally illegal I would not win anything. That is just stupid for anyone to say that. The police get sued for excessive foce.
If this wasn't the case then next time I see someone doing something illegal I"ll just run them over with my car. Well because I can say they were doing something illegal.
