My question involves real estate located in the State of: Tennessee, Hamilton County
I am considering the purchase of land that borders a private road. The private road was established and is owned by the neighboring parcel owners. Benefit of the easement is explicitly stated in the deed of one of the parcels that was once part of a larger tract of land.
The original owner of the larger tract of land subdivided the land, transferred ownership of parcels to heirs, and established the easement (private road) for ingress, egress and utilities above and along said easement, for the benefit of all portions of the original tract and subdivided parcels.
We are investigating the possibility of entering into a Private Road Maintenance Agreement with the parcel owners, but that has not come to fruition as of yet. If it does, my question will be moot.
If the owner of the property I am looking to buy builds his own road on his own property to allow access to the parcel I am buying (which borders said easement mentioned above), would the utilitiy companies be able to access and connect my service to the utilities that exist along the private road without the permission of the private road owners?
Is there any reference in TN Code or case history to support the answer to my question?
