My question involves criminal law for the state of: illinois
Hello. A couple weeks ago my husband and I had an altercation. He ended up choking me but in self defense. Problem is, in my written statement I told police that he hit first. In his written statement he put that I hit him first. I had a small mark on my neck and knee but nothing major. He had a small mark on his face. They took pictures of both of us. They arrested my husband for domestic battery physical force. From here, I am wondering what I should do at this point. I do not want him charged as we have a child together and he has a good job which if he has this on his record, he could lose his job. Should I talk to states attorney? Do I tell them I struck first even if my written statement says different ? Could I then have it flipped on me or could I get in trouble for a false statement? If he goes to his arraignment and I do not appear will they drop it or subpoena me? I am new and clueless to all of this. We have been married six years and both have squeaky clean records. Does he need an attorney, do I? Thanks in advance for reading.
