I have question regarding Asylee granted case: Can a derivative (child) obtain green card when his father (principle) does not apply for his green card?
- I came to states at age of 12 years when my father applied for us after his Asylee application was approved and we joined our father here in the U.S. my mother and I applied for green card after 1 year as we were granted Asylee but my father did not. We did not put any further inquiry into the case; however, now after ~20 years - I have completed graduate degree and now to get into my study program, I need to be permanent resident (green card holder). I tired telling them that i do not have any work restriction with asylee status but they refuse to take me until i get green card. Now I am desperate to get green card; I would like to put inquiry into my case. I talked with my father about his case, he is NOT going to apply for his green card and he wishes to stay on asylee granted status. I would like to apply for PR and I was wondering and wanted advice if I can pursue this further and obtain green card without my father applying for his?
I am planning to get lawyer advice, but I wanted to get an idea before handed.
