My question involves estate proceedings in the state of: Florida
I am a remainderman in a life estate that was set up over 20 yrs ago without my knowledge. The life tenant tenants assets were mostly rolled into a living trust some yrs ago when she became incapacitated and went into a nursing home. I was recently notified of the the life estate when the life tenant died. Over the last several yrs (at least 10) the trustee allowed the son of the life tenant to occupy the property. Since i had been unaware of the life estate until recently I had someone check on the property and found that the property has not been maintain for several yrs and the son of the life tenant still living in the property. From what i gather the lawn has not been mowed in yrs and the house was trashed. Now, My question is what culpability does the the estate or the trustee of the living trust have in not maintaining the property. Am I stuck or is there some legal recourse against the estate because now i have a tenant that refuses to move who has not maintained the property and it is obvious the trustee did not fulfil his responsibilities in maintaining the property.
