My question involves juvenile law in the State of: Kansas
I'll call the subject of this post Jack
Jack is 17 (will be 18 in approx 5 1/2 months) and lives the majority of time away from his parents home. Jack's family life isn't great, there is emotional and verbal abuse, but no physical toward him (there is toward some siblings). The family dynamics are very poor. Jack has a part time job, his own transportation and is doing well (much better than previous years) in school. The place he is staying is very stable and structured. All needs are met, he is well cared for and he is considered a member of their family. Jack established residency at this place in August and has spent the majority of his time since then there. Jack's parents do know where he is staying and don't object. Jack & the people he stays with attend the same church events weekly with Jack's parents. They have said 'legally' he must stay at least 4 nights a week at their house. He was adopted from foster care @ 12 & this maybe has something to do with SS checks. He has plans for college and has chosen his college, visited etc. but Jack's parents refuse to fill out his FAFSA or college application.
Jack has looked into emancipation and it is so rare that he hasn't been able to learn if it is a viable option to pursue or if it would be a waste of the filing & lawyer fees.
Can anyone advise if emancipation might work?
If Jack chooses to not return home at all, what legal issues could arise? What steps should be taken from here forward?
