My question involves an injury that occurred My parked car was rammed by another driver and deemed total loss. While coming up with my car valuation, the appraiser noted unrelated damage which costs about $700. This damage was caused by the tow truck who was called by the police department. They asked me if they would like to use his service to get my car towed to nearest body shop. I denied but asked he could move it back in the parking slot since my car was in the middle to the road. Police officer asked the tow truck driver and he used his truck's bare front bumper to push the car from the back into the parking slot. This caused scratches (and a small hole) which my insurance company is referring as the unrelated damage.
My insurance company advised me to pursue the case on my own and get the money recovered from that tow company. I called this tow company and the owner mentioned that they won't pay a dime.
What are my options to recover that disputed amount? I made a video right after the accident which shows no damage to the back bumper of the car. I then took an image after 2 hrs before another tow truck came to tow my car to the body shop. This image shows the damage.
Also, the cash value offered for my vehicle is less based on the excellent condition and low mileage (Mazda CX 5 2016.5, 10.5K Mileage). The at fault driver's insurance company hasn't even accepted the liability as of today. Should I settle the claim through my insurance or wait for the other insurance company?
I am at no fault for this accident and it's been a crazy mess.
