To Modify or Keep Current Order Until Father Modifies

My question involves a child custody case from the State of: CA

I currently have an order in the state of CA which was put in effect while my son and I lived in NY. It gave me full custody of him and granted his father visitation as he could in NY. His father did not have an established relationship with him. I came back to CA and nothing has been modified officially in court but my son's father is trying to call the shots with how we are splitting up time. But he is getting the quality time with him after school and I'm only getting an hour before school and an hour before bed. He also sleeps at home with me 6 days a week. Weekends I primarily have him. Since modifying our agreement is inevitable and will ultimately be better to have it on paper, should I try to file first with the parenting plan I'd like to see? Or wait until he files? It's definitely not always going so smoothly not having official orders.
