My question involves collection proceedings in the State of: Indiana
In 2014 and 2015 we were facing loss of jobs and financial hardships.. We contracted with ClearOne Advantage to do a debt pay off program. Yes, in hindsight it was a stupid mistake. We could have done it ourselves for less money. And no where did they explain to us that we would then be hit with a tax issue as the balance minus the pay off would be considered income. We got hit with a $10,000 tax bill for that. I am not sure that we really saved anything at all. BUT. I digress.
THis week I received notice for a debt recovery company that 2 of these accounts in the debt pay off program were bought by them and they now wanted to collect on them We paid them off in this debt pay off program in 2014-2015. But apparently no one bothered to mark the pay off correctly. Now they are saying that I owe roughly $6000 on these 2 loans. WTF>>>
I contacted ClearOne Advantage to see if they could send me the information of when they paid them off and the balance they sent. We moved and unfortunately, I can not find any of my records. No one bothered to get back with me for over a week. ANd then when they did, they said that they did not have any of these old records.
What can we do to get any records of these pay offs? THe original credit card companies obviously don't have them or they would not have turned them in for debt collection. BTW, I am 64 and on Social Security Disability. My husband is 72 and on Social Security. We live on very little income and wiped out our savings to do the debt pay off program. Yes, another stupid mistake.
A friend told us that at our age, and having no income other than SSD and SS, they could not legally get us to pay. We do own a home and I am afraid that a lien would be placed on it. We also have a small savings plan that we have managed to put away but it would no way cover these two loans. PLUS, I already paid them once.
