My question involves a child custody case from the State of: Texas
My ex and I have been divorced for 11+ years. Child support was ordered to be automatically garnished from his wages from the day we finalized.
Prior to finalization he was ordered to pay half of daycare until mediation when support was determined and after which he paid neither for around 8 months. He was original petitioner so I had to take him back to court to finalize and bring up contempt for non-payment. he showed up with check and judge did nothing.
Since then I've had to take him back for contempt 2x already. Last time involved non payment of medical, refusing to provide medical insurance info, and 12 tardies on days he had children overnight on school days. It was a giant mess. he agreed to mediation infront of judge, then didn't show because "I told my lawyer I can't afford it" - several more court days where his lawyer argued to postpone, then showed up and his lawyer was on suspension with the state bar.
At this point he was finally slapped on the wrist for his antics and ordered to pay about 75% of my legal and if memory serves like a single 500 dollar fine.
Fast forward 3 years to now and he was either fired or laid off from his job that he's held for 20+ years (and always complained how much he hated when married) and has just not paid a penny. he's ordered to pay 500/mth + 250/mth medical (last court date I had medical coverage moved to me because of all the games he was playing)
His current balance is just shy of 6K.
He's told my kids "I don't want a job because I want to stay home and take care of you guys" (Fwiw, kids are past daycare age and he sees them 4-6 weekend days per month depending on how many weekends a month has) and he's been living with his parents and 2 adult sisters for the last 11 years, driving his mom's old car. There is no impetus for him to get a job.
We filed and have a court date in approx 3 weeks. I get really anxious (no idea why I am....I shouldn't be) with this stuff.
Laywer asked for jail time and fines for contempt as allowed - but this isn't the first time we've filed contempt and I think thats just a standard language/scare tactic.
At the time we go to court he will be 9 months in arrears for support and medical.
I've googled and it would APPEAR texas is cracking down on this sort of tomfoolery, but again past history has been pretty lenient every time he violates court orders.
Nobody here has a crystal ball of course, but I was wondering what I should anticipate?
I think Ex has finally tapped out parents (money wise) so I don't expect he will show up with a check for balance owed again - but he could.
I expect he will show up and shrug and say "I can't find a job. sorry. broke"
