My question involves a traffic ticket from the state of: California
Hello! I was driving north on I-5 ascending the grapevine in Santa Clarita, CA and was in #3 lane and approached a back up of trucks. There were many cars traveling on the road, but not enough to slow down traffic. I turned on my blinker and changed into the #2 lane and there was a very slow truck so I kept my blinker on, checked my mirror and over my shoulder and changed into the #1 lane. Immidiately after the lane change, I was pulled over by a motorcycle highway patrol. At first I didn't realize it was for me and then had no idea why I was being pulled over. I was very surprised when he told me he pulled me over for an unsafe lane change. He claims I entered the lane with less than 5 ft. from the car behind me. As I mentioned, I had my blinker on, I check my mirrors and my shoulder. I did see that there was a car in the #1 lane however, I felt it was safe to change lanes. Additionally, the blind spot sensors (which are very sensitive) that my vehicle is equipped with did not activate, so I couldn't have had less than 5 ft. as the officer claims.
- My ticket reads 21658(A) unsafe lane change #3-1 it also states that my approx. speed is 70 in a 65 max speed (however he just wrote unsafe lane change and did not mention speed to me or on the ticket)
I have never had a moving violation before. I have read up on unsafe lane change violations and see it is very subjective. I do plan on contesting as I honestly feel like I did not make an unsafe lane change and most importantly would hate to have points on my record, but a pricey ticket doesn't sound great either.
I would greatly appreciate any advice on the best way to handle this! Thank you in advance
- Also, I was reading on another thread for a unsafe lane change ticket that an informal discovery request can be made. I found an informal discovery conference form on lacourt.org
Is this something I should request? Not sure if this will help/hurt my case or what I should state as the "nature of discovery dispute"?
