My question involves real estate in the State of: Mass
There is a retaining wall that runs from the front to the back of the property then across the property. At the front the walls starts at about 1’ by the time you get to the back the wall is about 5’. There is also a fence on top of the wall that runs it’s enterty. My property is the lower property. The land was surveyed and the wall is the property line. So the actual wall is on the nabors property mine starts are the face of the wall. The wall looks the be constructed with concrete and CMU blocks. There are many cracks and it is starting to lean into my property. It is unknown which property originally constructed the wall.
So I have 2 questions.
1. Who owns repair and maintenance of the wall?
2. If the wall falls into my property who’s liable for it? It’s about 3 feet away from my home in some locations and if it falls it will probably hit the house.
